These terms govern the purchase of limited edition photographs from Steve Austin Fine Art Photography, a brand of Biophilic Media LLC, an Arizona limited liability company. Placing an order means you have read them and agreed to them. Please read the section on returns before you order, because it differs from what you may expect from an online purchase.

1. What you are buying

Each photograph is offered in four presentations, and each presentation carries its own separate edition. The editions are not pooled.

• Collector's Choice, edition of 25
• Signature Acrylic, edition of 50
• Signature Metal, edition of 50
• Fine Art, edition of 100

Every print is made to order. Nothing is held in inventory, and your print is produced after you buy it.

Institutional commissions and multi-piece installations sit outside the edition program and are arranged directly. If you are working on a project of that kind, write to me rather than ordering through the cart.

2. Edition commitment and closure

An edition size is a promise, and I treat it as one. When an edition sells out, it closes permanently. I will not reopen it, extend it, issue a second edition of the same image in the same presentation, or release the image in that presentation under a different name or size ladder.

A closed edition stays closed even if demand continues. That is what makes your number mean something.

3. Artist's proofs

Ten artist's proofs exist for each image. They are held outside the numbered editions, are not counted against any edition, and are not assigned to a particular presentation. Proofs are used for exhibition, for reference, and occasionally for direct sale. Each one is marked as an artist's proof on both the print and its certificate, so a proof is never mistaken for a numbered piece.

This is disclosed here, on the Acquisition page, and on every certificate of authenticity. Collectors deserve to know the full number of prints that can ever exist for an image.

4. Certificate of authenticity

Every print ships with a certificate on archival paper recording the image title, the presentation, the edition size, your print's number within that edition, the dimensions, the substrate specifications, the date of production, and my signature. Keep it. The certificate is what establishes provenance if you insure, appraise, gift, or resell the work.

If you lose a certificate, write to me. I keep a permanent record of every edition number and who it went to, and I can issue a replacement marked as such.

5. Pricing, payment, and tax

Prices are in United States dollars. Payment is taken in full at checkout, and production begins after the payment clears.

Prices rise as an edition fills, and may also change as production, framing, or shipping costs change. I reserve the right to change prices at any time. A change never affects an order already placed. The price you saw at checkout is the price you pay.

Sales tax is calculated at checkout based on your shipping address where I am required to collect it.

If a price appears on this site because of a typographical or technical error, I may cancel the order and refund you in full rather than fulfill it.

6. Frame selection and custom dimensions

For framed presentations you choose the ROMA Moulding series, the finish, and the liner after ordering. I will contact you to walk through the options. Production time starts when you confirm those choices, not when you place the order.

Custom dimensions outside the published size ladders are possible for some images and are quoted individually. A custom piece is still numbered within its edition and still counts against it. Custom work is non-cancelable once production begins.

7. Production time

Typical production windows before shipping:

• Metal, 2 to 3 weeks
• Acrylic and paper, 3 to 4 weeks
• Framed work, 5 to 6 weeks

These are estimates, not guarantees. Large work, custom dimensions, and periods of heavy demand run longer. If your piece will take significantly longer than the window above, I will tell you before you have to ask.

8. Shipping, delivery, and title

Work is crated or packaged to survive freight and ships insured for its full purchase price. Larger pieces travel by freight carrier and may require an appointment and someone present to receive them.

Title and risk of loss pass to you on delivery. Until the crate reaches you, the work is my responsibility.

You are responsible for giving me an accurate, complete address and for receiving the shipment. A delivery that fails because the address was wrong, or because nobody was there across repeated attempts, may incur redelivery or storage charges that fall to you.

9. International orders

I ship internationally. Import duties, customs fees, brokerage charges, and destination taxes are yours to pay, and they are separate from the price and shipping cost you paid at checkout. Customs practice varies widely by country and I cannot predict what your authority will charge.

Customs paperwork will declare the accurate purchase value. I will not undervalue a shipment or describe it as a gift.

If a shipment is refused or abandoned at customs, the cost of return or disposal falls to you, and the order is not refundable.

10. Damage in transit

If your work arrives damaged, I make it right at no cost to you. There is no argument to have.

Two things are needed from you. Photograph the crate or packaging before you fully unpack it, along with the damage itself. Then write to me within seven days of delivery. The photographs are what let me file the freight claim, and the window is what makes the claim possible at all.

Acrylic, metal, and paper are replaced. These surfaces cannot be repaired without compromising the work, so a damaged piece is remade rather than touched up.

Framed work is usually replaced as well. The one exception is minor damage to the frame itself, a small scratch or a chipped corner on the moulding or liner, where the print and its mounting are sound. In that case I arrange and pay for a finisher to come to you and repair it in place. You will not be asked to crate a framed piece and ship it back. If the damage is beyond a cosmetic repair to the frame, or if you would simply rather have a new piece, you get a new piece. I will not argue that a repair is good enough.

Your edition number does not change either way. A repaired piece keeps its number, because it is the same object. A replacement carries the number of the piece it replaces, and the damaged piece is destroyed rather than returned to circulation. Your edition number is never duplicated and the edition count never changes.

The same applies to a defect in materials or workmanship that shows up on arrival.

11. Returns

All sales are final. Prints cannot be returned or exchanged, and orders cannot be canceled once production begins.

Here is why. Your print does not exist until you order it. It is made for you, numbered to you, and recorded against an edition that closes when it fills. A returned print cannot go back into inventory, because there is no inventory. It cannot be resold as new, because its number now belongs to you in a permanent record. Accepting returns would mean either destroying work that took weeks to make or quietly weakening the edition, and I am not willing to do either.

What I offer instead is everything I can put in front of you before you commit. Scale diagrams that show the work at real size in a real room. Detailed material specifications. Placement guidance. And a direct line to me. If you are unsure about size, presentation, or how a particular image will behave in your space, ask me before you order. I would far rather spend an hour helping you choose correctly than have you live with something that does not fit.

This clause does not limit your rights under section 10 if the work arrives damaged or defective.

12. Copyright and reproduction rights

Buying a print gives you the physical artwork. Copyright in the image stays with me.

You may display the work wherever you like, private or public, and you may photograph it in your space and share those photographs. You may sell or gift the physical print, and I would appreciate hearing about it so the edition record stays current.

You may not reproduce the image commercially, make derivative works from it, license it, use it in advertising or packaging, or use it to train machine learning systems. Reproduction and licensing rights are available separately. Write to me if you need them.

Please do not alter, crop, reframe in a way that damages the piece, or remove the signature or edition marking.

13. Color and appearance

Screens differ. Your monitor, your phone, and your room's light will each render an image differently, and a print under gallery lighting is a different object from a photograph on a backlit display. Minor variation between what you saw on screen and what arrives is normal and is not a defect.

Each print is checked against a reference before it ships.

14. Care

Archival materials last a long time under reasonable conditions and degrade under bad ones. Direct sunlight, humidity swings, and improper cleaning will damage any print, and damage caused that way is not covered. 15. Limitation of liability

To the fullest extent the law allows, my liability arising from any order is limited to the amount you paid for that order. I am not liable for indirect or consequential losses, including installation costs, property damage arising from your own mounting or hanging, or business losses.

Large framed and acrylic work is heavy. Have it installed by someone competent, into structure that will hold it. Installation is your responsibility.

Nothing here limits liability that cannot be limited under applicable law.

16. Governing law

These terms are governed by the laws of the State of Arizona, United States, without regard to conflict of laws principles. Disputes will be heard in the state or federal courts of Maricopa County, Arizona.

Before anything reaches a court, write to me. Nearly everything can be resolved by two people talking.

17. Notices

Notices under these terms may be sent by email, to you at the address you provided at checkout and to me at [email protected]. Written notice may also be sent to Biophilic Media LLC, 18521 East Queen Creek Road, Suite 105-422, Queen Creek, Arizona 85142. Nothing in this section affects service of legal process, which is made on the company's statutory agent as recorded with the Arizona Corporation Commission.

18. Changes to these terms

I may revise these terms. The version in force for your purchase is the version published when you placed your order, and the date at the top tells you which that is.
